FW3 Ltd Terms and Conditions of Sale & Privacy Policy

Payment

We accept payment by cash, cheque, bank transfer, credit and debit cards. Credit and debit card transactions are managed by Lloyds Cardnet or Paypal. You can order through our website www.westhillbikes.com or by calling us free of charge on 0800 328 5708 or +44 1404 814292 if outside the UK.

Shipping and Handling

All bikes are currently eligible for free delivery in Mainland UK only. Delivery to N.Ireland, the Channel Isles and the Scottish Highlands incurs an additional charge of £35. Accessory orders valued over £50 are also free delivery in the mainland UK. Different rates apply for overseas shipping, please contact us for details.

Orders

Once you have placed an order with us, you will receive an email to confirm your payment method and the items ordered.

Specification

The manufacturer may change the specification of certain components at any time. Published specifications for all bicycles are as accurate as possible, but there may be minor variations on the published specification if necessary.

Delivery- Electric Bike

Once you have placed an order with us we will deliver the item within 5-7 working days if it is in stock . If your item is not in stock, we will inform you of when you can expect delivery. Next day delivery is available on some items, where stated, if the item is ordered before 1pm. We strongly advise you to keep all packaging and documents in case they are needed at a later date.

Delivery- Parts

Once you have placed an order with us we will deliver the item within 2 working days if it is in stock . If your item is not in stock, we will inform you of when you can expect delivery. Next day delivery is available if the item is ordered before 1pm. We strongly advise you to keep all packaging and documents in case they are needed at a later date.

IMPORTANT DELIVERY ADVICE

• Please do not accept delivery from the courier if you judge that the package and contents have been damaged.

• Please do not sign for a package as damaged even if the driver asks you to do so. Signing for damage will also void the insurance covering that consignment. If you accept a damaged shipment we will not be able to make a claim, so please be sure that it is in good condition before signing for it.

• You will be offered the option to Back-Order the items and should you choose to do this, we will endeavour to give you a true indication of the date upon which you should expect to receive said goods. If we fail to secure the goods you have back ordered within a reasonable (the estimated) time, you will be under no obligation to proceed further with that order.

Returns

Please return accessories via Royal Mail or other courier. If you wish to return an electric bicycle for a refund but are unable to return it to FW3 Ltd premises yourself, FW3 Ltd will arrange for collection from the delivery address at a cost of £49 per electric bicycle. This will be deducted from the refund for your returned electric bicycle. Please include a completed copy of our returns form with a reason for return to help us process your return as efficiently as possible • Please enclose the form with the product and package up securely in the original packaging if possible.

Return the item (or items) via Royal Mail or other courier to the address shown below and obtain a certificate of postage and a tracking number. We will provide an exchange or refund as required. Items should be returned in their original packaging within 30 days. We cannot assume responsibility for returned items that are lost in the post so we recommend that you use a service that provides a certificate of postage and a tracking number.. WEEE Regulations

The Waste Electrical and Electronic Equipment (WEEE) Directive is now UK law. The legislation aims to make producers pay for the collection, treatment and recovery of waste electrical equipment. The regulations also mean that suppliers of equipment like high street shops and internet retailers must allow consumers to return their waste equipment free of charge. The amount of WEEE we throw away is increasing by around 5% each year, making it the fastest growing waste stream in the UK. Much of the UK’s WEEE ends up in landfill, where the lead and other toxins it contains can cause soil and water contamination. This can have a harmful effect on natural habitat, wildlife and also human health.

Many electrical items that we throw away can be repaired or recycled. Recycling items helps to save our natural finite resources and also reduces the environmental and health risks associated with sending electrical goods to landfill. Distributors of new Electric and Electronic Equipment (EEE) have a part to play in reducing the amount of WEEE going into landfill sites. Under the WEEE Regulations, all new electrical goods should now be marked with the crossed out wheeled bin symbol. Goods are marked with this symbol to show that they were produced after 13th August 2005 and should be disposed of separately from normal household waste so that they can be recycled.

FW3 Ltd offers in-store take-back of old WEEE items on a like for like basis when a customer buys an equivalent item from us. For example, if you buy an electric bicycle from us, then you are entitled to return the old electric bicycle to our store. The WEEE item returned must fulfil the same function as the new item, therefore a customer cannot buy a new electric bicycle from us and then return a non-electric pedal cycle. Customers have to return their old items to us within 28 days of purchasing their new item. FW3 Ltd is not liable for the cost of return under these regulation. We will then re-use, recycle, or dispose of the WEEE. WEEE Registration no. WEE/DB2934XR

Limitation of Liability

We shall not be liable for incidental or consequential damages or expenses. This includes, but is not limited to, damage to property, lost income, profits, economic or commercial losses and third parties claims.

Our total liability in connection with or arising from the Order, whether in negligence or otherwise, shall be limited to the value of the Goods.

Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of Westhill Bikes or any of its employees or agents or fraud. These disclaimers and exclusions shall be governed by and construed in accordance with law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Ownership of Rights

All rights, including copyright, in this website are owned by or licensed to Westhill Bikes. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non–commercial use is prohibited without the permission of Westhill Bikes. You may not modify, distribute or re–post anything on this website for any purpose.

Accuracy of Content

Westhill Bikes has taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website.

We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the product on delivery. Packaging may vary from that shown.

However, we cannot guarantee that your use of this website or any websites accessible through it won’t cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website and screen out anything that may damage it. Westhill Bikes shall not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

You are responsible for maintaining the confidentiality of your password and account and any activities that occur under your account. Westhill Bikes shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account.

You can access our website home page and browse our site without disclosing your personal data, but if you do give us your personal details, you are accepting these terms. If you want to buy things from us, you will need to register on our site.
